About these terms
These terms apply when you sign in to Likelyread Cloud, from the Chrome extension or at app.likelyread.com, or buy a plan. Buying a plan forms a contract with us on these terms; Checkout asks you to accept them before you pay. The privacy policy explains how we handle personal data.
If you run your own Likelyread server, you use the software under its MIT licence, and these terms do not apply to it.
If you are a consumer, meaning you use Likelyread for purposes outside your trade, business or profession, you keep every right the consumer law of your country gives you. Where these terms treat business customers differently, they say so.
We may update these terms, for example when we add a feature or the law changes. We will email you at least 30 days before a change that affects a paid plan takes effect. If you do not accept it, you can cancel before then and we refund the unused part of your current period.
Your account
You sign in with a Google account. You must be at least 18 to buy a plan, and at least 15 to use Likelyread at all. Keep your Google account secure: what is done through your Likelyread account, including by the Chrome extension or an agent you give a token to, is treated as yours. "Sign out everywhere" on the Account page revokes every token at once. Tell us at once at hello@likelyread.com if you think someone else has used your account.
The service
Likelyread Cloud tells you when the emails you send from Gmail™ are opened, and why each open counted. What each plan includes is listed in the pricing section at the time you buy it.
An open means the tracking image in your email was loaded. Mail apps, image proxies and privacy features can load that image without anyone reading the email, or block it when someone does. Each verdict is our best reading of that evidence, not proof that a person read your email: do not rely on it where that difference matters.
We work to keep Likelyread Cloud available and your data safe, but we do not promise uninterrupted service, and features may change. We will not remove a feature that is part of your paid plan during a period you have paid for without offering a refund for the rest of that period.
Your data and your recipients
Your tracking data stays yours. You give us the permission we need to host and process it, only to provide Likelyread to you. You can export or delete it at any time, on every plan, from the dashboard.
When you track an email, you are responsible for your recipients' data. Tracking images can fall under the EU ePrivacy rules and the GDPR, and in France the CNIL recommends getting the recipient's consent before measuring opens of campaign emails, B2B included. Check the rules that apply to you before you track.
Acceptable use
Do not use Likelyread to:
- send spam or emails your recipients did not agree to receive, or track people where the law does not allow it;
- break the law or infringe someone else's rights, including privacy and intellectual property;
- attack, probe or overload Likelyread or other people's accounts, or get around plan limits or access controls;
- resell Likelyread Cloud or offer it to others as a hosted service without our written agreement. Running the open-source software yourself is always allowed under its licence.
Plans and prices
The Free plan tracks up to 500 emails a day and shows 30 days of history. Pro raises the limit to 5,000 tracked emails a day, keeps your full history and adds the features listed on the pricing page; it is sold monthly or yearly. Lifetime is Pro for a single payment, offered to the first 500 buyers.
Prices are in euros, and every customer is charged in euros, whatever their country. The pricing page shows prices before VAT. Checkout adds the VAT for your country and shows the total, VAT included, before you pay. Businesses can enter a VAT number at Checkout.
Payment and renewal
Payments are processed by Stripe; we never see your full card number. A monthly or yearly plan renews automatically at the end of each period, at the price then in force, until you cancel. We email you at least 30 days before a price increase applies to your renewal. If a payment fails, Stripe retries it; if it stays unpaid, your account moves to the Free plan.
Changing or cancelling a plan
Switch between monthly and yearly, update your card or cancel at any time from "Manage subscription and invoices" on the Account page; Stripe shows any amount due before you confirm. Cancelling stops the next renewal: Pro stays active until the end of the period you have paid for.
When Pro ends, your account moves to the Free plan. Tracking continues within the Free limits, and history older than 30 days is hidden until you upgrade again. You can still export all of it.
Lifetime
Lifetime gives you Pro for as long as we run Likelyread Cloud, for one payment and with no renewal. If we ever stop running it, we will tell you at least 90 days before, you can export everything, and because the software is open source you can keep using it on your own server. If that happens within three years of your purchase, we also refund the Lifetime price in proportion to the time left in those three years.
Withdrawal and refunds
If you ask within 14 days of your first payment for a subscription, or of buying Lifetime, we refund it in full, without asking why. This covers the 14-day right of withdrawal that consumers in the European Union have, and goes further.
To ask, email hello@likelyread.com from the address of your Likelyread account, or send us the model form below; you do not have to use it. We refund you within 14 days of your request, to the card you paid with, and your account moves to the Free plan.
Model withdrawal form
To: Hugo SEQUIER, hello@likelyread.com
I hereby give notice that I withdraw from my contract for the following service: Likelyread Pro (monthly, yearly or Lifetime).
Ordered on: …
Name of the consumer: …
Email address of the Likelyread account: …
Date: …
Signature (only if this form is sent on paper): …
After those 14 days, payments are not refunded, except where the law requires it or these terms say so: a change to these terms you do not accept, a paid feature removed during a period you have paid for, a lack of conformity, or the end of Likelyread Cloud.
Legal guarantee of conformity
If you are a consumer, we are responsible for any lack of conformity of Likelyread Cloud with what was agreed, for as long as your subscription lasts or, for Lifetime, for as long as we provide the service, under articles L224-25-1 and following of the French Code de la consommation. If Likelyread does not work as described, tell us at hello@likelyread.com. We will bring it into conformity free of charge within a reasonable time. If we cannot, or the problem is serious, you can ask for a price reduction or end the contract and be refunded for the period affected.
Suspension and termination
You can delete your account at any time from the Account page. Your subscription is cancelled at once, and your data is removed from the live database at once and from backups within 30 days. We may suspend or close an account that seriously or repeatedly breaks these terms, after warning you where the law and the circumstances allow. We will give you a chance to export your data unless the law prevents it. If we close a paid account for a reason other than a breach of these terms, we refund the unused part of your period.
Liability
We are liable to consumers as the law provides. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited by law.
For business customers, and as far as the law allows, we are not liable for indirect losses such as lost profits, revenue or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.
Intellectual property
The Likelyread software, including the Chrome extension, is open source under the MIT licence. The Likelyread name, logo and website content belong to us. These terms do not give you any right to them beyond using the service.
Complaints and applicable law
If something goes wrong, write to us first at hello@likelyread.com. We answer within 14 days.
These terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of that country and can bring proceedings where you live. Disputes with business customers go to the courts with jurisdiction for our business address.
